1. Agreement Overview
- This Agreement establishes a contractual relationship between Experience Guide LLC (“EXG”) and you, the Customer.
- By accepting these Terms & Conditions, you agree to:
- Assume full responsibility and liability for yourself, your guests, and invitees.
- Release and hold harmless EXG, its owners, managers, employees, affiliates, contractors, and property owners (collectively “the Company”) from any and all claims, damages, injuries, or losses.
- Indemnify EXG against any liabilities resulting from your actions or omissions.
- Reservations are not confirmed until you have accepted these Terms & Conditions.
2. Booking Requirements
- Minimum Stay: Unless pre-arranged otherwise, most weekends in peak season require a 3-night minimum and a 12-guest minimum.
- Shorter Stays: Reservations of <3 nights will only be accepted within 60 days of scheduled arrival date, pending availability.
- Smaller Groups: While groups with less than 12 guests are permitted, EXG reserves the right to bill at the 12-guest rate.
3. Check-In & Check-Out
- Check-in time is 4:00 PM unless pre-arranged otherwise
- Check-out time is 12:00 PM unless pre-arranged otherwise
- Early/late check-in or check-out is subject to availability and can only be authorized within 48 hours of scheduled arrival date.
- Failure to vacate at the designated check-out time may result in a penalty charge of one additional night, without further right of occupancy.
4. Property Access & Concierge
- Property address and access codes will be provided 48 hours prior to arrival.
- Guests are required to pre-arrange a scheduled arrival time with EXG for a personal welcome and quick property tour.
- Guests with special needs should contact EXG prior to booking to ensure accommodations are suitable.
5. Parking
- Street parking may be available but is not guaranteed.
- Guests are responsible for reading all posted signs. EXG is not liable for tickets, towing, or related expenses.
6. Reservation Changes & Substitutions
- In the event of overbooking, scheduling conflicts, or unexpected property issues, EXG reserves the right to relocate the Customer to accommodations of equal or greater quality within its own or affiliate properties, without liability.
- EXG cannot guarantee flexibility for reservation changes or special requests outside of these Terms.
7. Occupancy & Guest Rules
- Occupancy Limits: No more than the number of guests listed on the reservation may occupy or enter the property.
- Unauthorized Guests: Any unregistered or “stowaway” guest will result in a minimum $250 charge per person and may constitute a violation of Colorado law (CRS §12-44-102).
- Events & Gatherings: Private events and group gatherings outside of standard traditional vacation rental lodging must be approved by EXG prior to booking. Use of the property for events, parties, or gatherings without written consent will result in minimum $1,000 damages, cancellation of the reservation, and eviction without refund.
- Noise Ordinance: Denver City noise laws apply from 10:00 PM to 8:00 AM nightly. Each violation results in a minimum $1,000 fine and may result in eviction without refund. Please be respectful of the neighbors.
- Customers are fully responsible for all persons entering the property.
8. Prohibited Activities
- Tobacco Use: Smoking or tobacco use (including spliffs or tobacco-blended products) is prohibited inside or within 25 feet of entrances. Minimum cleaning fee: $500.
- Cannabis Use: Permitted in accordance with state/local law. Customers assume all risks and accept all liabilities related to cannabis consumption. Additional fees may apply for cannabis use inside of a rental property. Please inquire prior to booking.
- Pets: Not permitted. Evidence of pets will result in a minimum $500 cleaning fee.
- Adult Entertainment: Strippers, exotic dancers, escorts, or prostitutes are prohibited on the property unless pre-authorized by EXG. Violations will result in a minimum $1,000 charge per incident.
9. Property Use & Maintenance
- Customers are responsible for keeping property and furnishings in good condition.
- Moving, damaging, or misusing furniture/equipment will result in charges up to 200% of repair or replacement costs.
- Cleaning Fee: Each reservation includes a “standard cleaning fee” of $250–$350 which covers routine cleaning only. Excessive cleaning needs (e.g., stains, wax, glitter, large trash, damaged linens, marijuana concentrate residue, etc.) will result in additional charges.
10. Packages & Deliveries
- Deliveries must be coordinated with EXG prior to shipping.
- EXG assumes no responsibility for lost or undelivered packages. This includes but is not limited to Amazon deliveries and pre-stocking requests such as groceries and beverages.
11. Surveillance & Security
- Exterior security cameras are for guest safety.
- Tampering, disabling, or covering cameras will result in a $500 fee per camera, per occurrence.
12. Payment & Cancellation Policy
Payment
- Reservations within 60 days of arrival: payment in full required at booking.
- Reservations more than 60 days out: 25% deposit required; balance automatically charged 60 days before arrival.
- Additional guests (beyond included base occupancy) billed at $50/person/night.
- All charges appear as EXPERIENCE GUIDE LLC.
Cancellation
- Within 48 hours of booking: Full refund if arrival is 60+ days away.
- Within 7 days of booking (arrival <60 days): Credit valid for 12 months.
- More than 60 days before arrival: 75% credited for future stay (12 months validity), 25% forfeited.
- Within 60 days of arrival: No credits, refunds, or rescheduling.
- EXG reserves the right to cancel or refuse service at its discretion.
13. Legal Provisions
- Arbitration: All disputes resolved exclusively by binding arbitration under the American Arbitration Association in Colorado.
- Governing Law & Jurisdiction: Governed by Colorado law. If arbitration is waived, disputes must be filed in the District Court for the City & County of Denver.
- Attorney’s Fees: Prevailing party in litigation or arbitration is entitled to recover costs and legal fees.
- Amendments: Must be in writing and signed by both parties.
- Entire Agreement: Supersedes all prior agreements.
- Severability: Invalid provisions do not affect the remainder.
- Waiver: Failure to enforce any right does not waive future enforcement.
14. Disclaimer & Liability Waiver
The Customer acknowledges and agrees that:
- EXG, its owners, employees, property managers, affiliates, and contractors are not liable for accidents, injuries, illnesses, theft, loss, or damages occurring during the stay.
- All risks of lodging, transportation, and activities are assumed by the Customer and their guests.
- Disturbances from construction, roadwork, or external noise are non-actionable.
- By booking, the Customer releases, discharges, and holds harmless EXG and affiliates from all liability, including personal injury, death, property damage, or loss, however caused.
